Terms and Conditions

1. DEFINITIONS AND TERMS

  • SOTEO - is the trade name of SC SOTEO SRL, a legal entity with its registered office in Romania, Str. 12 nr. 13, Sat Turnu, Oras Pecica, Judet. Arad, having CUI: RO50292777.
  • Seller - SOTEO or any SOTEO partner
  • Buyer - a natural person / legal person or any legal entity that creates an Account on the Site and places an Order.
  • Client - a natural person / legal person who has or obtains access to CONTENT, by any means of communication made available by SOTEO (electronic, telephone, etc.) or based on a usage agreement existing between SOTEO and them, which requires the creation and use of an ACCOUNT.
  • Account - the section of the Site consisting of an e-mail address and a password that allows the Buyer to transmit the Order and which contains information about the Client/Buyer and the Buyer's history on the Site (Orders, fiscal invoices, Goods guarantees, etc.).
  • Site - the domain www.decocraft.ro, www.mercerie-dc.ro, www.creativmania.ro and www.soteo.ro and their subdomains.
  • Order - an electronic document that acts as a form of communication between the Seller and the Buyer through which the Buyer transmits to the Seller, through the Site, their intention to purchase Goods and Services from the Site.
  • Goods and Services - any product or service, including the documents and services mentioned in the Order, which are to be provided by the Seller to the Buyer as a result of the concluded Contract.
  • Campaign - the action of displaying for commercial purposes, a finite number of Goods and/or Services having a limited and predefined stock, for a limited period of time established by the Seller.
  • Contract - represents the distance contract concluded between the Seller and the Buyer, without the simultaneous physical presence of the Seller and the Buyer.
  • Content
    • all information on the Site that can be visited, viewed or otherwise accessed by using an electronic device;
    • the content of any e-mail sent to Buyers by the Seller by electronic means and/or any other available means of communication;
    • any information communicated by any means by an employee/collaborator of the Seller to the Buyer, according to the contact information, specified or not by the latter;
    • information related to the Goods and/or Services and/or the tariffs practiced by the Seller in a certain period;
    • information related to the Goods and/or Services and/or the tariffs practiced by a third party with whom the Seller has concluded partnership contracts, in a certain period;
    • data referring to the Seller, or other privileged data thereof.
  • Review - a written evaluation by the owner or beneficiary of a product or service, an evaluation written based on personal experience and their ability to make qualitative comments and to say whether the product or service meets the specifications mentioned by the manufacturer or not.
  • Rating - a way of expressing the degree of satisfaction of a User/Client/Buyer regarding a product. The rating is expressed in the form of stars, each product being able to receive a score from one star to five stars. This degree of satisfaction will always be associated with the written review of the User/Client/Buyer about a product or service.
  • Comment - appreciation or observation with a critical purpose, regarding a Review or another comment.
  • Question - a form of address to other Users/Clients/Buyers for the purpose of obtaining information about the products or services on the respective page.
  • Answer - written information that is transmitted to the User/Client/Buyer who asked a Question on the Site, on the page of a certain product. The answer represents an explanation offered by a User/Client/Buyer to another User/Client/Buyer within a discussion.
  • Document - these Terms and Conditions.
  • Newsletter - a means of periodic information, exclusively electronic, namely electronic mail (e-mail, SMS) about the Goods and Services and/or the promotions carried out by the Seller in a certain period, without any commitment on the part of the Seller with reference to the information contained therein.
  • Transaction - the collection or refund of an amount resulting from the sale of a Good and/or Service by SOTEO to the Buyer, using the services of the card processor approved by the Seller, regardless of the delivery method.
  • Specifications - all specifications and/or descriptions of the Goods and Services as specified in their description.

2. CONTRACTUAL DOCUMENTS

  • By registering an Order on the Site, the Buyer agrees with the form of communication (telephone or e-mail) through which the Seller carries out its commercial operations.
  • The notification received by the Buyer, after placing the Order, serves for information purposes only and does not represent the acceptance of the Order. This notification is made electronically (e-mail) or by telephone.
  • For justified reasons, the Seller reserves the right to modify the quantity of Goods and/or Services in the Order. If it modifies the quantity of Goods and/or Services in the Order, it will notify the Buyer at the e-mail address or telephone number provided to the Seller when placing the Order and will return the paid amount.
  • The Contract is considered concluded between the Seller and the Buyer when the Buyer receives from the Seller, via electronic mail and/or SMS, the notification of the Order's shipment.
  • For Orders to be delivered to the SOTEO headquarters and reservations of Goods and/or Services are valid for 5 working days from the registration of the Order by the Buyer.
  • The Document and the information made available by the Seller on the Site will form the basis of the Contract, supplemented by the warranty certificate issued by the Seller or a supplier thereof for the purchased Goods.
